Happy Birthday Brett. Love, Roger.

Today is Brett Favre’s 41st birthday.

For the first time in years, however, it isn’t Favre’s age or football prowess or indecision that has the media focusing on the Vikings starting quarterback.

At halftime of the Chargers and Raiders game, Commissioner Roger Goodell commented on the pending allegations against Favre.

“We are going through that and we are making sure we understand all the facts,” Goodell said.  “We’ll make a determination from there.”

A suspension is certainly a possibility if it is determined that Favre violated the NFL’s personal conduct policy.  Any suspension would immediately be announced to the public and Favre would have ten days to appeal the suspension.  The appeals process can vary as to how long it takes to come to a resolution.

Peter King cautions fans to not assume that Favre would get a suspension, however, even if he is found to have done the things he is being accused of.

“Don’t automatically assume that Favre, if found culpable in this case, is going to get a suspension because he has no previous violations of the Personal Conduct Policy,” King told Mike Florio. 

“They could find the offense so heinous that they could suspend him,” King noted, “but it’s not automatic.”

In the beginning of September, we pointed out that a recent case involving Patriots linebacker Brandon Spikes could have an effect on this case.  Spikes was suspended by the NFL for making a sex tape in college, which ended up on the internet, and was subject to the NFL’s personal conduct policy despite the fact that he wasn’t employed by the NFL when the incident occurred and was recorded.

Many Favre defenders have pointed out that Favre has not seemingly committed a crime and that these allegations are coming up quite some time after they actually occurred.  The NFL suspended Spikes for making a sex tape which certainly is not a crime even though it occurred before he was even in the NFL.

Furthermore, making unsolicited sexual advances to a coworker can be considered sexual harassment which is indeed a crime. 

Former Vikings quarterback Sean Salisbury was suspended as an employee of ESPN for sending a photo of his bare “jock strap area” to a female coworker, which was first reported by none other than Deadspin.com.  After a denying the allegations for a long time and threatening a lawsuit against Deadspin, Salisbury eventually admitted his guilt.

As for whether or not Favre has ever shown a pattern of behavioral issues, which could weigh into whether or not he is suspended, is a matter that could be argued either way.  Officially, however, Favre has never been suspended by the NFL previously.

If a suspension were to be handed down, King expects that it wouldn’t happen until the end of this month.

    Hahaha… seriously though… if Favre was THAT STUPID to actually do this… he deserves to be punished. Sending pictures of your junk to a female coworker is indeed sexual harassment and would get you fired immediately anywhere else.
